Publisher Agreement
Welcome to Middlebrow Network! This Publisher Agreement (the “Agreement”) is a vital contract between you and Middlebrow Network (“we,” “us,” “our”). It outlines the rules and constraints governing your use of Middlebrow Network’s products and services, referred to as “Middlebrow Network,” for distributing newsletters and associated content. By using Middlebrow Network for this purpose, you become a Publisher, necessitating the creation of a Publisher account. Those who subscribe to your newsletters are referred to as Readers.
1. Eligibility
To use Middlebrow Network, you must be of legal age to form a binding contract. If not, you need parental or guardian consent, and they must agree to this Agreement on your behalf. We comply with the Children’s Online Privacy Protection Act (“COPPA”), not knowingly collecting information from children under 16. 2. Ownership
You retain ownership of your created content. Anything you post, upload, share, or provide to Middlebrow Network remains yours, protected by copyright and intellectual property laws. However, you grant us a limited license to operate Middlebrow Network, enabling content promotion and support. This license includes worldwide, nonexclusive, sublicensable, royalty-free, fully paid-up, transferable rights for marketing your newsletters.
3. Relationships with Readers
- Sole Responsibility: You are solely responsible for your newsletters and their consequences. Our role is to assist in facilitating distribution.
- Stopping Publication or Deleting a Newsletter: You can delete newsletters at your discretion. If you cease publication before a paid subscription term ends, refund obligations are your responsibility. We are not obligated to issue refunds.
- Disputes: We are not involved in disputes between you and users. We are not liable for your relationships with users and won’t provide legal advice.
- Reporting a User: Flag users violating our Terms of Use by emailing [email protected]. We may suspend or terminate access at our discretion.
- Support: Provide a current email address for inquiries about your newsletters.
4. Acceptable Use
- Legal Compliance: Ensure your use complies with the law and this Agreement. We aren’t responsible if you break the law using Middlebrow Network.
- Content Guidelines: Don’t publish harmful, fraudulent, deceptive, threatening, abusive, or objectionable content. Adhere to Middlebrow Network’s Content Guidelines.
- Interference: Don’t disrupt or damage Middlebrow Network or third-party properties. Unauthorized access is prohibited.
- Legal Compliance: Don’t infringe on laws, regulations, or third-party rights. Avoid spreading harmful computer code or programs.
